Tier 4 of the Points Based System has replaced the old rules relating to student migrants.

The Tier 4 (General) student category is for adult students who wish to come or remain in the United Kingdom for their post 16 education.

Applicants aged 16 or 17 years old who wish to study a course at or above national qualification framework level three can apply under Tier 4 (General) or under Tier 4 (Child) subject to clarification from the approved education provider (Tier 4 sponsor).

Those who wish to study English as a foreign language must apply as a Tier 4 (General) student.

Those wishing to apply as a Tier 4 (General) student must demonstrate that they have 40 points using the UK Border Agency Points Based calculator. Points are scored as follows:

30 Points will be awarded for having a valid Confirmation of Acceptance of Studies which the applicant will get for studying a course at an acceptable level with an approved education provider (Tier 4 Sponsor) and for having acceptable English language skills.

10 Points will be awarded for demonstrating that the applicant has sufficient money (also known as maintenance or funds) to cover course fees and living costs. Living costs will generally be based on the length of the course being studied and whether this is being undertaken within or outside inner London.

If your application is successful you will generally be allowed to stay in the United Kingdom for the full length of your course and for some additional time after your course finishes.

During your period of stay you must not claim any state benefits that you are not entitled to and you may be required to register with the police.

In addition as an adult student under Tier 4 (General) you will be allowed to work part time (up to 20 hours per week during term time or 10 hours per week if you are studying a course that is below UK degree level and it is not a foundation degree course). Applicants can work full time during vacations.
