immigration solicitors:

All employers wishing to employ non EEA workers or UK education providers wishing to sponsor overseas students must obtain a license from the UK Border Agency.  Once licensed, employers and UK education providers are able to sponsor overseas nationals.

Licensed sponsors are responsible for ensuring that migrants comply with immigration conditions by maintaining records and reporting any changes to the UK Border Agency.  Failure to do so can result in a license being down graded or being withdrawn.

In order to ensure that sponsors are complying with their obligations the UK Border Agency will periodically undertake compliance checks.

Furthermore, if employers are found to be employing non EEA nationals who do not have permission to work in the United Kingdom they can face a civil penalty of up to £10,000 per employee and can also face prosecution.

TM Fortis Immigration Solicitors have considerable experience in assisting sponsors with complying with their ongoing duties including prevention of abuse, maintaining assessment procedures, capturing any patterns of migrant behaviour early which may cause concern, addressing possible weaknesses in sponsors’ processes which cause those patterns and generally monitoring compliance.

We are able to provide you with general guidance to ensure that you are fully compliant with the UK Border Agency’s requirements and can arrange visits to sponsors’ premises in order to undertake a full audit and identify weaknesses within existing systems.
