All employers wishing to employ non EEA workers or UK education providers wishing to sponsor overseas students must obtain a license from the UK Border Agency.  Once licensed, employers and UK education providers are able to sponsor overseas nationals.

Licensed sponsors are responsible for ensuring that migrants comply with immigration conditions by maintaining records and reporting any changes to the UK Border Agency.  Failure to do so can result in a license being down graded or being withdrawn. 

In order to ensure that sponsors are complying with their obligations the UK Border Agency will periodically undertake compliance checks.

Furthermore, if employers are found to be employing non EEA nationals who do not have permission to work in the United Kingdom they can face a civil penalty of up to £10,000 per employee and can also face prosecution.
